I honestly wonder how this one will turn out for the shooter, especially considering that precedence will be set by any charges being filed.

Passer-by shoots robbery suspect fleeing Circle K

A man who police believe attempted to rob a Circle K store was chased down and shot in the leg by a passer-by, Phoenix police said.

The would-be robber attempted to steal cartons of cigarettes from behind the store counter at approximately 10:15 a.m. on Monday, police said. The Circle K store is located near Camelback Road and 16th Street..

The store manager confronted the man, and the suspect fled the store, police said.

A person in a vehicle pursued the would-be robber and reportedly shot the suspect in the leg. The suspect was unarmed, police said, but the gunman was under the impression he had a weapon, according to police.

David Burton, 46, was arrested on suspicion of the robbery and taken to St. Joe's Hospital and Medical Center for treatment of his injury."

On the outside, I'm sure people are going to scream vigilante justice. I can easily see the situation broken down as follows:

- shooter observes altercation at store that culminates in bad guy running out and manager chasing him, yelling "stop him!"

- shooter is in vehicle, makes chase to detain for police or place bad guy under citizen's arrest (or bring him back to manager as he was witness)

- bad guy already caused a rucus and now makes a move near waistband that looks like a drawstroke after he sees shooter intent on following him with vehicle.

- shooter determines there is a threat NOW and even disengauging from chase could = getting shot (threat of serious bodily harm), so he shoots and wings (legs) bad guy, situation is diffused.

My question is, when did the shooter draw the gun?

what would worry me is a similar situation that isn't as clear. Say a domestic argument where a guy1 is grabbing his keys from a gal so he can leave in his car and guy2 decides a robbery has taken place. Guy2 yells "hey MFer, get back here" and peels out towards guy1 with his car. Guy1 thinks he's going to get run over or worse, sees that Guy2 has a gun drawn... and Guy1 is armed too. Someone gets shot first but lives... I guess that's the reason for all the drama in court!
