1985, Wilmington, CA. I had a 1911, openly worn IWB, speed position, in front of hip. The chamber was empty, because I was living in this guy's garage,making smg's and silencers. We'dhad words, I entered his place. He owed me $400, and when I asked for it, he threatened to call the cops. I said:" Get you a club, boy". He was in another room. when he rounded the corner of the room I WAS in, I saw that he had a crescent wrench. He was a lardass, 280lbs, 5', 10" or so. STill, ANYONE can charge 12 ft in 1.5 seconds or less. He didn't make 2 full steps, before I'd drawn, jacked the slide, and had a Weaver on him, and he STOPPED, still out of reach of my gun. :) I had my back to a wall, just having come in thru the bedroom window, (from where I'd hollered at him from outside the house) Many guys besides me KNOW that speed into action can prevent your having to fire. .50 second slower, and I'd have HAD to put a .45 swc into him.

It isn't self defense when you told him to get a club, you aggravated the situation, and you escalated it...That's murder.

It isn't self defense when you create the situation that escalates to the point where now you have to shoot. When he threatened to call the cops you should have left. Then when you told him to get a club, you basically stated your intention to do him harm.

You were in his place, and you failed to leave. You threatened violence.

There's ample case law on this.

Murder, plain and simple.

This comes from

the same guy who time after time kept shooting out a plate glass window for paybacks over a vending machine soda,....Melvin gets his kicks from behind the scene.

The Castle doctrine in effect locally says,, if you come through my window, unanounced, uninvited, you are mine to kill without thought of retreat or escape. Your actions put you into that compromised situation. You, smallbore, are a defective.

:crap: you know;f'ng around like that....going into his house cwearing/carrying a rig that probably cost a lot more than the four yards this guy owed you....man there's ways to reinforce a point without extending yourself into that kind of hornet's nest.....man that WAS stupid for only $400.00.I got someone in NH,who's in arrears to me for a lot more than that.He tried to take advantage on a debt when he thought I was going to be "unavailable"(that Worcester County matter);I went though the courts because I had not yet had MY name cleared yet and did NOT need to have TWO courts taking an interest in me at the same time.It sucks,because even though you want to hit some people until they change shape....WTF,I did the right thing this time around ;maybe it will work in my favor for a change.
You would have been better off just getting the guy in a different setting and letting HIM escalate;like you said he was a fat f#$k;with all you've told us here about your PT/martial arts conditioning I'm certain it would have been ....interesting.
